Rules for the Use of Ski Runs and Conduct on the Ski Runs
The Rules for the Use of Ski Runs and Conduct on the Ski Runs (hereinafter referred to as the “Rules”) shall constitute a part of the Agreement for the Use of Liepkalnis Ski Runs.
1. General Terms and Conditions
1.1. The present Rules for the Use of Liepkalnis Ski Runs (hereinafter referred to as the “Ski Runs”) and Conduct on the Ski Runs shall govern the procedure for use of the Ski Runs and adjacent areas and conduct thereon as well as the rights and duties of the user of such Ski Runs and adjacent areas.
1.2. The Ski Runs shall include the area covering the downhill run area and lifts used specially for sliding down with the alpine skis or a snowboard.
1.3. The legal relationship between the User of the Ski Runs (hereinafter referred to as the “User”) and the Operator (hereinafter referred to as the “Owner”) shall be set forth in the present Rules, in the Civil Code and other applicable legislation.
1.4. The Agreement for the Use of Ski Runs (hereinafter referred to as the “Agreement”) shall be concluded at the moment when the person purchases a Ski Pass for use of the lift and the Ski Runs or otherwise lawfully acquires the Owner’s authorisation or confirmation for use of the Ski Runs (hereinafter referred to as the “Ski Pass”).
1.5. The Owner shall authorise the User to use the Ski Runs only according to the terms and conditions set out herein.
1.6. The Ski Runs may be used only by the persons who have a valid Ski Pass purchased or received at the cash registers of Liepkalnis Ski Runs from the personnel of Liepkalnis Ski Runs. The persons not granted with the Owner’s authorisation to use the Ski Runs or not having a valid Ski Pass shall not be entitled to use the Ski Runs.
1.7. The present Rules shall not imply the Owner’s offer to enter into the Agreement. The User’s action of purchasing the Ski Pass from the Owner or authorised person thereof shall be recognised as an offer to enter into the Agreement under the terms and conditions set forth herein. Issue of the Ski Pass by the Owner or authorised person thereof, in turn, shall be recognised as an offer. The Owner or authorised person thereof shall not be obliged to accept the expressed offer. The present Rules and other circumstances cannot be considered as a confirmation that the offer expressed by the person shall be necessarily accepted.
1.8. The User’s duties and the Owner’s rights set out herein shall be binding upon the persons actually using the Ski Runs or are in the territory of the Ski Runs not using them without the Ski Pass or with an invalid Ski Pass or prior to purchase of the Ski Pass or upon expiry thereof. Any person using the Ski Runs and/or being on them shall undertake to observe the terms and conditions set out herein.
1.9. The right to use the Ski Runs shall be granted to the natural person not younger than 12 year old. Minors under 12 year old shall be entitled to use the Ski Runs only under direct supervision of adults.
1.10. Dogs and other animals (exercise with or without a muzzle, keep in a cage etc.) in the Ski Runs shall not be allowed.
1.11. Teaching sliding with a snowboard or skis or carrying out any economic or commercial activities on the Ski Runs shall be allowed only with a written prior consent of the Owner. A breach (suspicion of a breach) of the present paragraph shall constitute grounds for acknowledging that the User has seriously breached the rules and/or prohibiting from using the Ski Runs for an indefinite period.
2. Term of the Agreement:
2.1. As of the moment of purchasing the Ski Pass the natural entity shall be deemed to be the User within the meaning of the present Agreement and the present Agreement shall be binding upon him/her.
2.2. The Agreement and the right to use the Ski Runs shall expire if the time indicated in the Ski Pass has ended or all downslides have been used.
2.3. The Agreement and the right to use the Ski Runs shall expire if the person’s Ski Pass is annulled by reason of a failure to comply with the terms and conditions hereof.
3. Sports Equipment:
3.1. The present Agreement shall entitle the User to use the Ski Runs for sliding down the hill with alpine skis or a snowboard (hereinafter referred to as the “Sports Equipment”).
3.2. Only the Sports Equipment which is in good order may be used in the Ski Runs.
3.3. The User shall satisfy himself/herself of the technical condition of his/her Sports Equipment. If the User has doubts or has no information about the technical condition of his/her Sports Equipment, he/she shall be obliged to apply to the specialists of the Ski Runs at the Sports Equipment Rental Centre for an advice.
3.4. The snowboard shall have a safety belt which shall be fastened to the User’s leg and the skis must have brake “pedals” so that the snowboard or skis could not slide down the slope without the User’s knowledge and cause losses or injuries to other Users. The lower part of the ski poles must have protective plates.
3.5. The terms and conditions hereof shall be binding upon all Users irrespective of whether they use their own Sports Equipment or rent the Sports Equipment from the Owner or third parties.
3.6. Sledges, sheets, cross country skis etc. and other downslide equipment except for the one set out herein shall not be allowed on the Ski Runs.
4. Rights and Duties of the User:
4.1. The User shall be entitled to use only the part of the hill slope intended only for downhill run with alpine skis or a snowboard (hereinafter referred to as the “Downhill Area of the Ski Runs”). Use of the lift trail for downslide shall be prohibited. The ski lift trail shall be deemed to be the control line along which Users go uphill using the ski lift.
4.2. The User shall be obliged to comply with the terms and conditions hereof, observe the signs and indications on the Ski Runs related to the Ski Runs, use thereof and the Sports Equipment. The User shall be obliged to comply with requests or instructions regarding the Ski Runs, use thereof and the Sports Equipment expressed by the personnel wearing the respective uniforms or otherwise marked with the respective distinguishing sign (hereafter referred to as the “Personnel of the Ski Runs”).
4.3. The Users shall be prohibited from using the Ski Runs or being on them (with or without equipment) if they are under the influence of alcohol, narcotic or psychotropic substances. The Personnel of the Ski Runs or any other person authorised by the Owner shall be entitled to request to immediately verify if the User is not under the influence of alcohol, narcotic or psychotropic substances. A refusal to allow immediate verification if the User is not under the influence of alcohol, narcotic or psychotropic substances or preventing from verifying if the User is not under the influence of alcohol, narcotic or psychotropic substances shall be recognised as intoxication with alcohol, narcotic or psychotropic substances and has analogous legal consequences as determination that the User is under the influence of alcohol, narcotic or psychotropic substances. Use of the Ski Runs or being on them (without or without equipment) being under the influence of alcohol, narcotic or psychotropic substances (irrespective of the intoxication level) shall be deemed to be a serious breach hereof.
4.4. The User shall be entitled to use only the Sports Equipment which is in good order on the Ski Runs. The User shall be obliged to satisfy himself/herself that the Sports Equipment is in good order before each downhill run.
4.5. The User shall be prohibited from walking on the downhill area and the lift operation area. In cases where the User is forced to walk on the Downhill Area of the Ski Runs in order to pick up the fallen down part(s) of the Sports Equipment (for example, a ski which has slid down the Ski Runs after he/she fell down) or in order to help in case of an accident, the User shall be obliged to walk with maximum precaution in order not to disturb other users.
4.6. The User with Sports Equipment in good order shall be prohibited from standing or sitting on the Downhill Area of the Ski Runs or the ski lift trail without any reason. Fall, failure of the Sports Equipment, rendering of help to a casualty or other User who has fallen down may be considered as a good reason. After stopping, the User shall try to leave the Downhill Area of the Ski Runs as soon as possible.
4.7. The User shall assume full responsibility for his/her safety, health and life on the Ski Run, and shall be responsible for the chosen downhill run speed and manoeuvres which must not exceed his/her skills and pose a threat to safety of other Users of the Ski Runs.
4.8. The User shall waive any rights of claim and shall undertake not to bring any claims or demands (whether property or other) for bodily injuries, damages or losses (traumas, damages to the Sports Equipment, vehicles etc.) against the Owner if such injuries, damages or losses has arose as a result of a breach of or non-compliance with the present Rules.
4.9. The part of the Ski Runs called “Snowboard Park” marked with the respective signs may be used by persons who are experienced and whose skills conform to the complexity level of jumps and figures. Only skiers wearing helmets and over 16 years old shall be entitled to use the Snowboard Park. The personnel shall have the right to prohibit any User from using the Snowboard Park if his/her skills or downhill run manner pose danger to himself/herself or other Users.
5. Downhill Skiing Conditions:
5.1. Before a downhill run, the User shall be obliged to satisfy himself/herself that he/she would not pose any danger to himself/herself and other skiers.
5.2. Before every downhill run, the User shall evaluate the quality and condition of the snow surface of the Ski Runs and presence of other persons on the downhill are with a view to performing a safe downhill run.
5.3. The User shall be entitled to make a downhill run only after satisfying himself/herself that the downhill run is safe. The User shall be prohibited from using the Ski Runs if he/she has any doubts that the quality or condition of snow is not appropriate for a downhill run even if a ski lift is in operation. The User shall be prohibited from being in the Downhill Area of the Ski Runs if a snow grooming machine (snowcat) is operating or is present on the Ski Run. The User shall be obliged to give way to a snow grooming machine (snowcat) or special service vehicles of the Ski Runs.
5.4. The User may overtake another User both from the right and from the left. The User must leave sufficient space of the Ski Run for manoeuvres of the User he/she overtakes.
5.5. The User shall be obliged to keep a distance from the persons in front of him/her and avoid collisions with the persons in front of them. The User skiing from the top shall be responsible for a collision and, in the event of a collision, the consequences caused by such collision with a person behind or in front of him/her on a downhill run.
5.6. In blind turns of the Ski Runs or where the situation is not clear, the User shall be allowed to ski with the speed allowing avoiding any collisions irrespective of the situation.
5.7. The User shall be prohibited from crossing the control line which marks off the ski lift trail from the Downhill Area of the Ski Runs.
5.8. The User shall be obliged to provide help to persons involved in an accident. Any accident must be immediately reported to the Personnel of the Ski Runs and, if necessary, the User must provide help.
6. Terms and Conditions Concerning Use of a Ski Lift:
6.1. Before moving uphill:
6.1.1. The User shall be obliged to wait in a queue at a ski lift.
6.1.2. Hooking and unhooking to a ski lift shall be allowed only in the dedicated areas. While moving uphill unhooking shall be allowed only upon a special notice from the Personnel of the Ski Runs. One hook/handle (platter type lifts) may be used only by one User. A hook/anchor ski lift (T-Bar type lift) shall be used by not more than two Users.
6.1.3. The User without ski lift usage experience shall inform the Personnel of the Ski Runs at the ski lift so that the personnel could provide help.
6.1.4. The User shall use appropriate close-fitting clothing and keep pockets and studs closed so that such parts of the ski lift as a hook, handle, anchor (hereafter referred to as the "Handle/Anchor”) would not trip on clothing.
6.2. When starting moving uphill:
6.2.1. The User (skier) shall remove pole straps and keep the poles in the hand put through the ski lift. In case of moving uphill with a snowboard, detach one foot from the snowboard fastenings.
6.2.2. The User shall stand directly at the ski lift, but not closer than 0.5 m to the cable vertical line so that passing Handles/Anchors of the ski lift did not touch the User. The Owner shall not compensate for the damages caused by the Handles/Anchors of the ski lift to the User’s clothing.
6.2.3. The User shall grip the Handle/Anchor with his/her free hand dragging himself/herself forward towards the moving direction. When the movement has commenced: in case of a “multilift” type lift, the User shall place the handle behind the back around the waist line; in case of T-Bar ski lift, the User shall place the handle behind back below the hip line; in case of “platter” ski lift, the User shall place the handle/anchor between the legs.
6.3. While moving uphill:
6.3.1. The User shall direct his/her skis or a snowboard in the uphill movement direction.
6.3.2. When moving uphill with a ski lift the User shall move straight without any turnings and zig-zag movements taking into consideration the uphill trail. In case of fall, the User shall leave the ski lift trail as soon as possible.
6.3.3. The User shall be prohibited from releasing the Handle/Anchor directly before ski lift supports.
6.4. When finishing moving uphill:
6.4.1. In order to avoid traumas (bodily injuries) of the User and damage to the User’s clothing and the Sports Equipment, before unhooking the User shall be obliged to make certain that the Handle/Anchor has not tripped on clothing or Sports Equipment.
6.4.2. The User shall be obliged to unhook from Handle/Anchor only when the skis are on horizontal surface.
6.4.3. The User shall be obliged to immediately leave the area towards the closest slope in order to avoid possible traumas caused by the following User’s Handle/Anchor.
6.4.4. When unhooking the User shall not be allowed to drag the Handle/Anchor aside or carry out other actions which may cause the ski lift cable to break loose or other damage.
6.4.5. In case the ski lift poses a threat to any User of the Ski Runs, the User shall be obliged to loudly ask to switch off the ski lift by pressing the “STOP” button.
7. Responsibility of the User:
7.1. The User shall be liable damage and losses caused to third parties or the Owner as a result of use of the Ski Runs.
7.2. The Personnel of the Ski Runs shall be entitled to cancel the User’s Ski Pass and prohibit him/her from using the Ski Runs if he/she has failed to comply with the requirements hereof. In the event of a serious breach hereof, the User shall be prohibited from using the Ski Runs for an indefinite period.
7.3. The User shall be liable for damage and losses incurred by third parties and the Owner as a result of a breach hereof including a failure to observe the ski lift usage conditions.
7.4. In case of loss of the Ski Pass, the User shall have no rights to renew it or compensate the paid amount.
7.5. The User shall not be entitled to request to exchange the Ski Pass for money if the Ski Pass has become valid and the User is dissatisfied with the surface condition of the Ski Runs, weather or any other conditions.
8. Responsibility of the Owner:
8.1. The Owner shall not assume responsibility for accidents or losses incurred by the User or third parties as a result of a breach of the terms and conditions set out herein.
8.2. The Owner shall not assume responsibility for damage to or a theft of equipment, vehicles or other personal belongings.
8.3. The Owner shall not be liable for damages or losses caused as a result of improper use of a lift or failure to comply with the safety rules.
9. Other Terms and Conditions:
9.1. The Owner shall be entitled not to allow the person to use the Ski Runs if he/she does not have the Ski Pass or the Ski Pass has expired included the cases of annulment of the Ski Pass. The Owner shall have the right to assume actions to evict such persons from the Ski Runs.
9.2. Hereby the User and the person bound by the present Agreement shall authorise the Owner or authorised third person thereof to collect and record their personal data in accordance with the terms and conditions hereof. The Owner shall be entitled to record and process personal data of the User and the persons bound by the present Agreement (photographs, video and other audio and visual information in the form of records) if such person has used the Ski Runs without the Owner’s authorisation or used a forged Ski Passed despite the Owner’s prohibition and in cases where the Owner or authorised persons thereof annulled the Ticket for such person due to a breach of the terms and conditions hereof. The Owner shall have the right to collect, register, enter, keep personal data on text, audio and visual data carriers, handle, modify, use, transmit, delete, process and hand over such data to the owners of other ski runs.
9.3. Any disputes and disagreements over the Rules, breaches thereof or liability for use of the Ski Runs shall be resolved by mutual negotiations. In the event of a failure to resolve such disputes and disagreements by mutual negotiations, both Parties shall be entitled to apply to the court in Vilnius City in accordance with the procedure prescribed in the laws of the Republic of Lithuania.
Rules of the Snow Park
• Always evaluate your skills, since only you are responsible for your own safety.
• Slide in the SNOW PARK only with Twin Tip skis and snowboards.
• If you are not an experienced snowboarder/skier, please don’t repeat tricks performed by more experienced skiers.
• Before sliding in the SNOW PARK, please examine the figures and evaluate your own experience and skills.
• If the respective figure is simultaneously reached by two persons, the one who slides first should run down and the second one should wait till the person skiing in front of him/her safely slides down the hill.
• Beware of inadvertent people sliding across your run.
• In the event of an accidental fall, please immediately stand up.
• Be polite. Don’t treat others in a manner you wouldn’t want to be treated!
• Don’t stop in a poorly visible places.
• Never miss out your snowboard. If you take it off, please put it on the snow with the binding down.
In the Snow Park it is prohibited
• TO SLIDE WITHOUT HELMETS.
• To slide for the persons under 16 years old without supervision of the parents or instructors.
• To set up or change the figures by the visitors of the park.
• To take a rest on/between the figures of the SNOW PARK.
• To slide being under the influence of alcohol or narcotic and toxic substances.
